Terms & Conditions
Version 1 — pre-launch, last updated 21 September 2026. Each version of these terms is dated; the version in force when you act is the one that applies.
Welcome to Tap2Wafa, digital loyalty stamp cards that live in your customers’ Apple Wallet and Google Wallet. These terms are a real agreement, and we wrote them to be read rather than scrolled past. The longer sections start with an In plain words summary. The summary helps you read; the full text governs.
These terms incorporate by reference our Privacy Policy (tap2wafa.com/privacy) and, for subscribed merchants, the plan allowances published on our pricing page at the time of your purchase. Together, these are the entire agreement between us.
1. Who these terms are for, and how you accept them
In plain words: cafés and businesses agree to these terms when they sign up. Website visitors and waitlist joiners are covered by the visitor sections only. Your customers never contract with us directly.
- Visitors & waitlist joiners: sections 1–3 and 16–19 apply to you.
- Merchants (a café or business that creates an account): everything applies to you. You accept these terms on the acceptance screen — an unchecked box beside “I agree to the Terms & Conditions and Privacy Policy”, both linked, which you tick before your first use of the dashboard; the sign-up page links both documents in the same words. We record when you accepted and which version.
- The service and this site are intended for business use by adults (18+). If you accept for a business, you confirm you have the authority to bind that business.
- Your customers (the people holding stamp cards) never sign anything with us. Their relationship is with your café; our promises about their data live in section 8 and the Privacy Policy.
2. The waitlist
- Your email is used for two things only: your invitation and major launch news. No marketing blasts, no sharing, no selling.
- Joining the waitlist guarantees nothing : no launch date, no feature set, no access order. It is an expression of interest, not a contract for service.
- Leave anytime: one email to support@tap2wafa.com removes you.
- While in pre-launch, the site is offered as-is and its content may change as the product develops.
3. What Tap2Wafa is
Tap2Wafa provides digital loyalty infrastructure: stamp cards in Apple Wallet and Google Wallet, a scan-to-stamp flow for your counter, a merchant dashboard, and customer broadcasts. We provide the tooling. Your loyalty program is yours — its rules, its rewards and its promises (see section 9).
4. Plans, pricing, and the free month
In plain words: prices are on the pricing page. Your first month is free with everything included. We never auto-charge you, and price rises never touch time you already paid for.
- Fees are as published at tap2wafa.com/pricing at the time of your purchase, in the currency and by the payment methods shown there.
- Price changes: existing subscribers get at least 30 days’ written notice before any price increase, and no change ever applies to an already-paid period.
- The free month: every merchant business gets one full month free, with every feature and no limits. One trial per actual business (not per email address). No payment details are needed to start.
- No auto-charge, ever. Our payment rails are push-based: you choose to pay; nothing is ever pulled from you. When a trial or paid month ends without renewal, the service pauses. That is all (section 5).
- The free-month offer may change for future signups; it never changes retroactively for anyone already in their month.
- Taxes: fees are exclusive of any applicable taxes, which each party bears as the law assigns them.
5. Renewal, grace, pause, and your data’s safety window
In plain words: if you are late renewing, nothing breaks for 4 days. After that we pause, and there are no fines, ever. Your data waits 90 days for you, then it is deleted.
- A subscription month starts when your payment confirms. Renewal is up to you, and nothing auto-charges.
- Grace: if renewal is late, service stays fully on for 4 days, with reminders. Your customers never see their cards die because you had a busy week.
- Pause, not punishment: after grace, the dashboard goes read-only and cards stop earning new stamps. Passes already in your customers’ wallets remain. They just go quiet.
- The 90-day window: from the pause, your card design, customer list, and stamp history are kept safe for 90 days. Pay any time in that window → instant reactivation, everything exactly as you left it, no late fees, no penalty.
- After 90 unpaid days, your data is deleted in line with the Privacy Policy. (Export any time before that — section 8.)
6. Uptime: our target and what you get if we miss it
In plain words: we aim for 99.5% uptime. If we are down through our own fault, we give you the time back. Apple, Google and the payment networks are outside our control.
- Target monthly uptime: 99.5%. This is a target we run the platform to, not a guarantee of uninterrupted service.
- If we miss it due to our own fault, your subscription is extended by the downtime, rounded up to a full day. This extension is your sole and exclusive remedy for availability shortfalls.
- Excluded from the calculation: (a) planned maintenance announced in advance and kept to limited monthly hours in low-traffic windows; (b) force majeure events (section 17); (c) outages of third-party platforms we depend on, including Apple Wallet, Google Wallet, and payment providers; (d) issues caused on your side. Cards already saved in wallets remain visible on customers’ phones even while servers are unreachable, and new stamps resume when service returns.
- Planned maintenance is notified in the dashboard in advance.
7. We keep improving the service — and betas are betas
- We continuously improve, add, and adjust features. We will not materially reduce the service’s core functionality during a period you have already paid for without prior notice.
- Features marked beta or early access are experimental: provided as-is, may change or end at any time, and are excluded from the section 6 uptime target.
8. Your data, and your customers’ data
In plain words: your customer list is YOURS. Ask support and you get your export. We keep only anonymous statistics, and we never sell data.
- You own your customer data : the names, the optional phone numbers and the stamp history of your café’s customers. We are the custodian, not the owner.
- Export on request: email support@tap2wafa.com and we provide your full customer data export (CSV), normally within 7 days, during your subscription and not only at exit. Export requests are handled through support so every export is reviewed and logged. There is no self-serve bulk export.
- When you leave: the same 90-day window as section 5. Export freely, then deletion.
- What we keep: anonymized, aggregated statistics only, for example the average stamps per week across cafés. Nothing in them identifies a person or a café.
- We never sell or share your data or your customers’ data. Period. The Privacy Policy is the detailed record of this promise.
- Your customers’ consent: when a customer joins your loyalty card, they provide their name (and a phone number only if they choose) and consent to us and you processing it to run the program, including receiving your card updates and broadcasts. That consent is revocable: a customer can ask you or us for deletion at any time.
9. Your loyalty program is yours — including its promises
In plain words: you set the rules and rewards, so honoring them is on you. If a customer fills a card, the free coffee is your promise, not ours.
- You define your program: stamp rules, rewards, validity. Communicate them clearly and honestly to your customers, and run your program within the laws that apply to your business.
- You must honor the rewards your cards promise. Disputes about earning or redeeming rewards are between you and your customer. Tap2Wafa provides the tooling and the tamper-proof records, but the reward itself is your obligation, and we are not liable for a merchant’s refusal or failure to honor it.
- On request, we can provide you the stamp records relevant to a dispute. The signed stamp system exists exactly so that “did this happen?” has a provable answer.
10. Fair use — what’s not allowed
In plain words: use it honestly for your real business. Don’t forge stamps, don’t farm free trials, don’t misuse messaging. Honest cafés will never notice this section.
- Lawful business use only. You are responsible for your own café’s legality: your offers, your rewards, your tax affairs.
- No stamp fraud: forging, replaying, or tampering with stamps, QR codes, or the scanner is a material violation, and so is attempting to bypass the signed-stamp mechanics.
- No trial abuse: fake “new business” accounts or re-imported data to farm free months is a material violation.
- Broadcasts: every plan includes wallet broadcasts — your offers and news, delivered straight to the loyalty card in your customers’ Apple Wallet and Google Wallet. To keep these messages welcome and reliably delivered (Apple and Google set anti-spam rules for every pass platform, and your plan includes a sending allowance shown on the pricing page), keep broadcasts about your own business and within your allowance.
- Account security: keep your login credentials and cashier device access safe. Actions taken under your account are yours; tell us immediately at support@tap2wafa.com if you suspect unauthorized use.
11. Enforcement — the ladder
In plain words: minor problems get a warning first. Serious fraud gets suspended immediately. Every decision can be reviewed by a human.
- Minor issues → warning → then temporary suspension if unresolved → then termination.
- Serious fraud or illegal use → immediate suspension, no warning owed.
- Termination for cause forfeits remaining prepaid time. This is the only financial penalty anywhere in these terms, and only misconduct can trigger it.
- Enforcement decisions are human-reviewable: contact support@tap2wafa.com. Nothing automated locks you out beyond human recall.
12. Intellectual property — and your feedback
In plain words: the platform is ours; your brand is yours; we display your logo on your cards because you let us. Ideas you send us stay yours, but we may use them.
- The platform is ours: the software, design system, and the Tap2Wafa brand. Your subscription is a license to use the service while subscribed. Nothing more is transferred.
- Your brand is yours: your logo, name, and card designs built from your assets. You grant us a limited license to display them on your passes, dashboard, and broadcasts. That license ends when you leave, after the 90-day window.
- You confirm you have the rights to the content and branding you upload.
- Feedback: we love hearing ideas from our cafés, and some of Tap2Wafa’s best features will start as merchant suggestions. Ideas you share stay yours, but by sharing them you give us permission to use them in the service freely and forever, without payment or confidentiality obligations. If you’d rather keep an idea private, simply don’t send it. Feedback is always optional, never required.
- Saying we work together: we may name your business as a customer (for example, a logo on our site). If you’d rather we didn’t, one email to support@tap2wafa.com opts you out.
13. If something goes wrong — liability
In plain words: neither of us can sue the other for more than roughly what was recently paid, and nobody pays for indirect losses. Fraud is never protected.
- Cap: to the maximum extent the law allows, either party’s aggregate liability under these terms is limited to the greater of (a) the fees paid or payable by the merchant in the 3 months before the claim, or (b) 100,000 IQD.
- No indirect damages either way: lost profits, lost customers, lost goodwill, or other indirect and consequential losses are excluded for both parties. This includes losses claimed to arise from loyalty-program malfunctions, changes, or interruptions beyond our express commitments.
- Not capped: the merchant’s unpaid fees; either party’s fraud or willful misconduct; liability arising from stamp fraud.
- Beyond the express commitments in these terms (the section 6 target and remedy, the section 8 data promises), the service is provided “as is.”
- Nothing in these terms excludes liability that cannot lawfully be excluded.
14. Indemnity — covering each other’s back
In plain words: if we get sued because of YOUR content or misuse, you cover us. If your use of OUR platform triggers an IP claim, we fix it or refund you.
- You cover us against third-party claims arising from: content or branding you uploaded without the rights to it; your violation of these terms; or your own program’s non-compliance with laws that apply to your business.
- We cover you in this way: if the platform itself is claimed to infringe someone’s intellectual property, we will fix it, replace the affected part, or, if neither is reasonable, end the affected service and refund your unused prepaid remainder. This is our full obligation for such claims, within the section 13 cap.
15. Leaving — cancellation and termination
In plain words: cancel anytime, with no exit fee. Your paid month runs out and that is that. If WE ever shut the service down on you without cause, you get your unused money back.
- You can cancel anytime, no reason needed, no exit fee. Service runs to the end of the paid month; there are no partial-month refunds.
- The fairness mirror: if we terminate your account without cause, or discontinue the service entirely, we refund the unused remainder of what you prepaid, pro-rata.
- Termination for cause is section 11. After any ending, the section 5/8 export-and-90-day rules apply to your data.
- Survival: sections that by nature outlast the agreement survive it, including unpaid payment obligations, intellectual property (12), liability (13), indemnity (14), data promises (8), and general provisions (16–19).
16. Changes to these terms
- We may update these terms. Material changes take effect for existing merchants 30 days after notice (email + dashboard). Continued use after the effective date is acceptance; if you disagree, cancel per section 15 before it takes effect.
- Every version is dated and archived, so there is never doubt about which text applied when.
17. Events beyond anyone’s control
Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disasters, war or civil unrest, government action, utility or internet failures, and cyberattacks beyond reasonable protective measures. Obligations resume when the event passes. Payment for service already delivered is not excused.
18. Governing law and disputes
- These terms are governed by the laws of the Republic of Iraq.
- Talk first: before any formal step, both sides agree to try to resolve the dispute in good faith through support@tap2wafa.com within 30 days.
- Unresolved disputes go to the competent Iraqi courts.
19. The small print that keeps this document working
In plain words: standard legal plumbing. Each clause stands on its own, email counts as writing, and headings are just headings.
- Entire agreement: these terms + the Privacy Policy + your plan’s published allowances are the whole agreement and supersede prior discussions.
- Severability: if a clause is held invalid, it is read down or replaced to the closest valid meaning; the rest stands.
- No waiver: not enforcing a clause today doesn’t waive it tomorrow.
- Assignment: we may assign these terms as part of a sale or reorganization of our business; your account and agreement aren’t transferable without our written consent.
- Notices & electronic communications: official notices go to support@tap2wafa.com (to us) and your account email (to you); you agree electronic communications satisfy any requirement that a notice be “in writing.”
- Language: these terms are written in English and may be published in Arabic and Kurdish translation for convenience. If the versions ever differ, the English version controls.
- Relationship: we are independent parties. Nothing here creates a partnership, agency or employment.
- Third-party links: links to sites we don’t control are conveniences, not endorsements.
- Headings are for convenience only.
